General conditions of sale
ARTICLE 1 – IDENTIFICATION AND SCOPE OF APPLICATION
These general terms and conditions of sale are entered into between International Panflute Academy, a private music school with an administrative address at midsestraat 7, 9200 Dendermonde, and any person accessing the website https://panflute-academy.com and wishing to make a purchase from International Panflute Academy, hereinafter referred to as the Buyer. The General Terms and Conditions of Sale govern all contractual relations between International Panflute Academy and the Buyer, relating to the sale of these services offered via the website and taking place in Europe and internationally, to the exclusion of all other contractual conditions.
ARTICLE 2 – AVAILABILITY – ENFORCEABILITY – MODIFICATION – NON-WAIVER
2.1 Availability of the General Terms and Conditions of Sale
The General Terms and Conditions of Sale are made available to the Buyer on a durable medium at the bottom of each page of the website via a link where they can be directly viewed and printed. These General Terms and Conditions of Sale may also be communicated by International Panflute Academy to the Buyer upon request by telephone, email, or postal mail, at the addresses and contact details indicated in Article 1.
By accessing the website, the Buyer agrees to carefully review these General Terms and Conditions of Sale, to comply with them, and to accept them without reservation before placing any order for services. In any event, a copy of these General Terms and Conditions of Sale may be sent to the Buyer upon request. 2.2 Enforceability of the General Terms and Conditions of Sale

ARTICLE 3 – MODIFICATION AND NULLITY

International Panflute Academy reserves the right to modify the General Terms and Conditions of Sale at any time, subject to posting these modifications on the website. In the event of modification of the General Terms and Conditions of Sale, the applicable General Terms and Conditions of Sale shall be those in effect on the date of the order placed by the Buyer. A non-modifiable copy (PDF) dated on that date shall be sent to the Buyer, if applicable, when placing the order. 3.2 Invalidity of a Clause of the General Terms and Conditions of Sale – Non-Waiver
The invalidity of a contractual clause does not invalidate the General Terms and Conditions of Sale, unless it is a clause that determines the will of one of the parties to enter into a contract for the sale/purchase of the service(s). The fact that International Panflute Academy does not invoke any of the clauses of the General Terms and Conditions of Sale cannot be interpreted as a waiver of the right to subsequently invoke any of the said clauses of the General Terms and Conditions of Sale.
ARTICLE 4 – CONDITIONS, REGULATIONS
All services and products offered for sale on the website are each subject to a description mentioning their essential characteristics. The photographs illustrating the services have no contractual value. International Panflute Academy cannot be held responsible for acts committed against or by minor participants. The services offered on the website are reserved for purchasers acting as individuals.
Registrations can be made throughout the year, until the end of the service period.
Payment can be made in one installment. All payments must be made by bank transfer or check, which must be submitted upon registration and will be made payable to “International Panflute Academy”.
In the event of occasional absence or withdrawal during the year, no refunds will be issued. Only withdrawals due to force majeure (moving, medical reasons) may be reviewed by the Board of Directors, which will decide on a possible refund (see Article 1148 of the Civil Code). Any service started remains due. The association systematically issues invoices. If necessary, families may request them.

International Panflute Academy reserves the right to modify these terms and conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the Buyer’s request.
ARTICLE 6 – SERVICES AND PRODUCTS
The services concerned include registration for courses offered by International Panflute Academy or for any other event organized by it or to which it contributes, without this list being exhaustive. These services and products are described and presented on the International Panflute Academy website with the greatest possible accuracy. However, if any errors or omissions occur in this presentation, the International Panflute Academy cannot be held liable.
International Panflute Academy reserves the right to cancel registrations if it is unable to meet the request.
ARTICLE 7 – PRICES
Prices for services and products are indicated in euros, with the understanding that International Panflute Academy is subject to VAT.
ARTICLE 8 – ORDER
Buyers wishing to purchase a service or product must complete the registration or contact form, providing the requested information. They must validate their request after checking it, and make payment according to the stipulated conditions.
Confirmation of the order constitutes acceptance of these general terms and conditions of sale.
International Panflute Academy will confirm the recorded request by email.
The computerized records, stored in the International Panflute Academy’s computer systems under reasonable security conditions, will be considered as proof of communications, orders, and payments between the parties.
ARTICLE 9 – PAYMENT TERMS
Payment is due upon request. Payment for the purchase of services and/or products is made only by check, cash, or bank transfer.
A paper invoice can be sent upon request.

In the event that International Panflute Academy is unable to fulfill the request, it will inform the requester as soon as possible.

ARTICLE 11 – LIABILITY
International Panflute Academy undertakes to perform its services responsibly. However, it shall not be held liable in the event that the failure to perform its obligations is attributable to a case of force majeure as defined by case law. Force majeure is defined as an insurmountable and irresistible event resulting from an event beyond the control of the parties, which consists of an event or series of events of a climatic, pandemic, bacteriological, military, political, or diplomatic nature. Likewise, the International Panflute Academy cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, including a break in service, external intrusion or the presence of computer viruses, when applying online.
ARTICLE 12 – PERSONAL DATA
In accordance with the law of December 30, 1992, amended by the law of July 30, 2018, relating to information technology, files, and civil liberties, personal information relating to the Buyer may be subject to automated processing.
International Panflute Academy, as data controller, retains this information and data in order to comply with legal and regulatory obligations. The Buyer has the right to access and rectify information concerning them. International Panflute Academy undertakes to delete from its database any member who leaves the proposed course program. The automated processing of information complies with the CNIL (French Data Protection Authority), and International Panflute Academy maintains a register designed to meet the most common data processing needs.
The data collected is used only to fulfill the request; it is accessible by the persons responsible for preparing and sending the request.
In accordance with the French Data Protection Act of July 30, 2018, a right of access and rectification is possible by contacting us at the following address <info@panflute-academy.com>.
The information collected is stored in a computerized file by International Panflute Academy, solely for the purpose of paying for individual services offered online.
The data is kept for 3 years. You may access your data, rectify it, request its deletion, or exercise your right to limit the processing of your data. You may withdraw your consent to the processing of your data at any time.
ARTICLE 13 – RIGHT OF WITHDRAWAL AND JURISDICTION
Right of withdrawal:
Pursuant to Consumer Code, you have the right to withdraw from this service, without giving any reason, within fourteen business days.
To exercise your right of withdrawal, you must notify midsestraat 7, 9200 Dendermonde, Tel: +32 477376738 or info@panflute-academy.com of your decision to withdraw by means of an unambiguous statement (e.g., a letter sent by post or email).
To comply with the withdrawal period, it is sufficient for you to notify us of your decision to withdraw before the withdrawal period expires. Effects of Withdrawal:
This refund will be made without undue delay and no later than fourteen business days from the day we are informed of your decision to withdraw.
We will make the refund using the same payment method you used for the initial transaction; in any event, this refund will not incur any fees for you.
Warranties:
In accordance with the Consumer Code, we guarantee the conformity of the services ordered for two years following the purchase. You must notify us by email, and we will consider repairing the item.
These guarantees apply without prejudice to the right of withdrawal.

Mediation:
In accordance with the decree of October 30, 2015, you may use a mediation service.
Any disputes arising from your order are governed by the courts in accordance with applicable law.
Since January 1, 2016, this notice has been mandatory; failure to do so is punishable by a fine of €3,000 to €15,000; it is the e-commerce merchant’s responsibility to subscribe to a mediation service.
